1. INTRODUCTION

1.1 Purpose
These Terms & Conditions (“Terms”) govern all services (“Services”) provided by CULLINAN CLINIC LIMITED (“Cullinan Clinic,” “we,” “us,” or “our”) at or through our premises located at 659 Fulham Road, SW6 5PY, London and through our affiliates, subcontractors, or service providers (collectively “Service Providers”).

1.2 Acceptance
By booking an appointment, undergoing treatment, or otherwise engaging with our Services, you (“Client” or “you”) agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. SCOPE OF SERVICES

2.1 Medical Aesthetic & Semi-permanent makeup Treatments
Cullinan Clinic offers a range of medical aesthetic procedures, including but not limited to injectables, skincare treatments, and Semi-permanent makeup (micropigmentation). Our Services are performed by qualified clinicians, aestheticians, technicians, or third-party Service Providers.

2.2 Non-Exhaustive Description
A detailed description of each treatment is available on our website or upon request. However, any written or oral description is for guidance purposes only and does not constitute a guarantee of results or outcomes.

3. APPOINTMENTS & CANCELLATIONS

3.1 Booking

  • Appointments may be booked by phone, email, or through our online booking platform. A deposit or booking fee may be required to secure your appointment; this will be communicated at the time of booking.
  • Your appointment is confirmed only after we receive any required deposit.

3.2 Rescheduling & Cancellations

  • If you wish to reschedule or cancel your appointment, you must do so at least 48 hours prior to the scheduled appointment time. Otherwise, you may forfeit your deposit or be charged a cancellation fee.
  • Repeated cancellations or no-shows may result in refusal of future bookings.

3.3 Late Arrivals

  • Arriving late may reduce your treatment time or result in rescheduling. In such cases, your deposit or session fee may be partially or fully retained at Cullinan Clinic’s discretion.

4. THIRD-PARTY SERVICE PROVIDERS

4.1 Qualified Service Providers
Some Services at Cullinan Clinic are performed by third-party Service Providers who are fully trained and qualified to carry out the treatments they offer.

4.2 Liability
While Cullinan Clinic takes all reasonable measures to ensure the qualification and suitability of any Service Provider, you acknowledge that certain risks are inherent in any aesthetic or medical procedure.

  • Cullinan Clinic is not liable for the actions or omissions of any third-party Service Provider beyond what is required by law.
  • Any claim or dispute regarding services provided by a Service Provider may require direct communication with that Service Provider.

5. MEDICAL DECLARATIONS & CLIENT OBLIGATIONS

5.1 Accuracy of Information
You agree to provide full and accurate medical history and disclose any health conditions, allergies, medications, or other relevant information that could affect your treatment.

5.2 Contraindications

  • Pregnancy: No treatment can be performed if you are currently pregnant. If you discover you are pregnant before or on the day of your appointment, you must inform us immediately, and your appointment will be cancelled or rescheduled as appropriate.
  • Other Medical Conditions: Certain treatments may also be unsuitable or require a doctor’s clearance if you have specific health concerns (e.g., diabetes, blood disorders).
  • Cullinan Clinic reserves the right to refuse or postpone treatment if we have concerns about your suitability or safety.

5.3 Following Instructions
You agree to follow all pre- and post-treatment instructions, including aftercare guidelines. Failure to do so may compromise your results and increase risks, and Cullinan Clinic assumes no liability for any outcome arising from non-compliance.

6. PAYMENT POLICY & REFUNDS

6.1 Pricing

  • Treatment fees will be set out in your booking confirmation or on our price list. We reserve the right to amend pricing at any time, but changes will not affect confirmed bookings unless mutually agreed.

6.2 Payment Terms

  • Payment for Services is due at the time of treatment unless otherwise agreed in writing.
  • We accept various payment methods, as advised on our website or on-site.

6.3 Deposits & Refunds

  • Deposits paid to secure an appointment are typically non-refundable, except under special circumstances determined at our discretion.
  • If a refund is deemed appropriate (e.g., due to our cancellation of your appointment), it will be processed via the original payment method within a reasonable timeframe.

6.4 No Guarantee of Results

  • Aesthetic and Semi-permanent makeup procedures are subjective and heavily dependent on individual skin type, medical conditions, lifestyle, and aftercare adherence. We do not guarantee specific results, and refunds will not be offered if you are dissatisfied with the outcome, except where required by law.

7. RISKS & LIMITATION OF LIABILITY

7.1 Inherent Risks
All aesthetic and Semi-permanent makeup procedures carry certain risks, including but not limited to infection, scarring, allergic reactions, dissatisfaction with results, pigment migration, and other complications.

7.2 Client Responsibility

  • By agreeing to proceed, you acknowledge that you have been informed of possible side effects and outcomes.
  • You accept the inherent risks and agree that Cullinan Clinic is not liable for any adverse reactions when the appropriate protocols have been followed.

7.3 Maximum Liability

  • Our liability for any claim arising from or in connection with our Services shall be limited to the amount you have paid for the specific Service in question.
  • Under no circumstances shall Cullinan Clinic be liable for indirect, incidental, or consequential damages.

7.4 No Waiver of Statutory Rights

  • Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.

8. INTELLECTUAL PROPERTY & CONFIDENTIALITY

8.1 Use of Materials
Any written or visual content produced by Cullinan Clinic, including but not limited to brochures, treatment plans, and educational materials, is the property of Cullinan Clinic and must not be reproduced or distributed without our express written permission.

8.2 Client Confidentiality
We maintain confidentiality of your personal and medical information in accordance with UK GDPR and the Data Protection Act 2018. We will not disclose any client data to third parties without your consent, except where required by law.

8.3 Photography & Marketing
We may take photographs or videos before, during, or after your treatment for record-keeping, monitoring progress, and/or marketing purposes. Any use of such media for marketing will require your prior consent. You can withdraw consent at any time by informing us in writing.

9. DATA PROTECTION

9.1 Compliance
Cullinan Clinic complies with the UK General Data Protection Regulation (GDPR) and the Data Protection Act 2018 with respect to handling your personal information.

9.2 Your Rights

10. COMPLAINTS & DISPUTES

10.1 Initial Resolution
We strive to provide the highest standard of service and care. If you are dissatisfied for any reason, please contact our clinic manager or email us at contact@cullinanclinic.com. We will endeavour to resolve any issues promptly and fairly.

10.2 Mediation
If no resolution is reached through initial discussions, the matter shall be referred to a mediator selected by Cullinan Clinic. Both parties agree to make a genuine and reasonable effort to resolve the dispute through mediation before commencing any court action. The fees and expenses of the mediation shall be shared equally by both parties unless otherwise agreed.

10.3 Confidentiality & Non-Disclosure
From the initiation of a complaint or dispute until a final resolution is reached (whether via mediation, court order, or otherwise), neither party shall disclose, publish, or otherwise communicate any details relating to the dispute—in any form, whether oral, written, or electronic—to any third party. This obligation extends to all conversations, documents, and records associated with the dispute.

  • Exceptions:
    • Disclosure to legal or professional advisors bound by confidentiality obligations.
    • Disclosure required by law, regulation, or a competent authority.

A breach of this confidentiality obligation may expose the breaching party to liability for damages, including but not limited to defamation, reputational harm, or other legal claims.

10.4 Court Proceedings
If mediation does not result in a resolution, either party may pursue legal action. These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the English courts.

11. GENERAL PROVISIONS

11.1 Amendments
We reserve the right to revise these Terms at any time. Any changes will be posted on our website or made available on-site. By continuing to use our Services, you agree to be bound by the updated Terms.

11.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11.3 Entire Agreement
These Terms, together with any other written agreement or policy referenced herein, constitute the entire agreement between you and Cullinan Clinic and supersede all prior agreements or understandings, whether written or oral.
